Terms and disclaimer

These terms apply to this website and, unless a signed contract says otherwise, to every quotation, sample and order from Shanghai MYM Material Co., LTD. ("MYM", "we", "us").

1. Website information

Product descriptions, specifications, photos and figures on this website are for general information. Values are typical unless stated otherwise and may change without notice. Photos may be illustrative. Nothing on this website is an offer, a warranty or a guarantee of fitness for a particular purpose.

The binding specification for any order is the one confirmed in our written quotation, order confirmation or contract. Where these differ from this website, the written document applies.

2. Quotations and orders

  • A quotation is valid for the period stated on it, or for 7 days if no period is stated. Prices for metals may be revised before order confirmation if raw material costs change.
  • An order is accepted only when we confirm it in writing and receive any agreed deposit.
  • Delivery times are estimates. We are not liable for delays caused by events outside our reasonable control, including raw material shortages, transport disruption, customs, power restrictions, government action, epidemics and natural events.
  • Risk passes to the buyer according to the agreed Incoterm. Loss or damage in transit is a matter for the carrier or the buyer's insurer under that Incoterm.

3. Samples

Samples are provided free of charge for evaluation only, as they are, without any warranty. Testing a sample is the buyer's responsibility, and approval of a sample means the buyer accepts that specification for the order.

4. Inspection and quality claims

The buyer must inspect the goods on arrival. Any claim about quality, quantity or specification must be made in writing within 3 working days of delivery and must include:

  • the order number and the lot or batch number from the label;
  • clear photos or video of the problem and of the packaging and labels;
  • test data where the claim concerns a measured property.

Goods under claim must be kept unused, unprocessed and in their original packaging, stored dry and protected, and made available to us or our appointed inspector. Claims made after 3 working days, or for goods that have been cut, processed, mixed, re-spooled or used, are not accepted.

We assess every claim against the confirmed specification, our batch records and retained samples. If we disagree with the buyer's findings, the goods may be tested by an independent laboratory accepted by both sides, such as SGS. The cost of that test is paid by the party whose position it does not support.

5. Our remedy

If our inspection, or the independent test, confirms that the goods do not meet the confirmed specification because of a manufacturing fault on our side, we will, at our choice, replace the affected goods, re-supply the shortfall, or refund the price paid for them, and we will pay the return and replacement freight. This is the buyer's sole remedy for non-conforming goods.

We are not responsible for problems caused by:

  • improper storage, handling, unwinding or processing after delivery, including moisture, corrosion and mechanical damage;
  • use outside the specification, or in an application we were not told about in writing;
  • specifications, drawings or materials supplied by the buyer;
  • variation within the tolerances of the confirmed specification or the applicable standard;
  • normal surface tarnish of silver or nickel that does not affect the specified properties;
  • damage in transit after risk has passed under the agreed Incoterm.

6. Limitation of liability

To the extent permitted by law, our total liability for any order, whether in contract, tort or otherwise, is limited to the price paid for the affected goods. We are not liable for any indirect or consequential loss, including loss of production, profit, revenue, contracts or goodwill, the cost of removing or reinstalling goods, or claims by the buyer's customers.

7. Payment

Unless agreed otherwise, payment is 30% deposit with the order and 70% against a copy of the bill of lading. Goods remain our property until paid in full. We may hold shipments or claims processing while any amount is overdue.

8. Intellectual property and use of this website

The text, photos, video and design of this website belong to MYM or are used with permission. You may not copy or republish them without our written consent. We may change or withdraw this website at any time and do not guarantee that it will be uninterrupted or free of errors. Links to other websites are provided for convenience and we are not responsible for their content.

9. Reviews and examples

Customer comments and application examples on this website describe individual experiences and are not a promise that every order or application will give the same result.

10. Governing law and disputes

These terms and any order are governed by the laws of the People's Republic of China. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute that cannot be settled by negotiation will be submitted to the competent people's court at MYM's place of business in Shanghai, China.

11. Changes

We may update these terms at any time. The version on this website at the date of our order confirmation applies to that order. If any part of these terms is found unenforceable, the rest remains in force.
